The RDW issued a provisional Art. 39 type approval. Other member states
can recognise that file on their own. That is how FSD Supervised is
already on the road in

countries — without a Brussels vote.
Germany, France, Italy and Spain are still in review. Berlin alone is
about 19% of the EU population, which is why it matters more than
another small yes.
The Technical Committee on Motor Vehicles is the EU comitology committee
that would need a qualified majority — 15 of 27 states covering 65% of
EU population — before the Commission can recognise the Dutch approval
across the whole bloc.
Solid = approved. Faint = if every “in review” country also says yes.
